Terms of Service
Version of 1 October 2026 · These terms are the general terms and conditions of use and of sale of Freqo.
1. Who we are
Freqo is a web analytics service operated by HSLP, whose details are given in the legal notice (“we”, “us”). These terms apply to anyone who creates an account or uses the Freqo service (“you”, the “Customer”).
Freqo is intended for professional use: businesses, organisations, freelancers and website publishers acting for the purposes of their activity. By creating an account, you confirm that you use Freqo in that capacity and that you accept these terms, our privacy policy and the data processing agreement, which form part of the contract.
2. Definitions
- Service: the Freqo dashboard at app.freqo.eu, the tracking script, the consent banner and every related feature.
- Site: a website or domain you add to your account.
- Visitor: a person who visits one of your Sites.
- Page view: one page displayed to a Visitor and counted by the Service.
- Plan: the subscription you choose, as described on freqo.eu.
3. Your account
- You give accurate information when you sign up and keep it up to date.
- You keep your password confidential. Everything done with your account is deemed done by you. Tell us without delay if you think your account has been misused.
- If you invite other users, you are responsible for what they do with your account and for removing their access when needed.
- You can delete your account at any time from “My account”. Deletion is immediate and permanent (see section 12).
4. The Service
Freqo measures the audience of your Sites: it counts visits anonymously for every Visitor and, when a Visitor consents, recognises their return visits. Its main features are described on freqo.eu. Features marked “Soon” are not yet available and are not part of the contract until they are released.
The Service evolves: we may add, change or remove features, as long as the essential function you subscribed to (audience measurement of your Sites) remains available. If a change significantly reduces a paid Plan, we will tell you in advance and you may cancel.
5. Free trial
New accounts get a free trial of 15 days on the Pro plan, with its features and limits, without a credit card. The trial is linked to the domains you add: each domain can benefit from one trial only. At the end of the trial, you can choose a Plan. Without a Plan, your account may be limited or switched to the Free plan, and statistics above its allowance may stop being collected.
6. Plans, prices and payment
- Prices are shown on freqo.eu in euros, excluding VAT. VAT is added where applicable.
- Paid Plans are billed in advance, monthly or yearly, by card or another method offered by our payment provider. They renew automatically for the same period until you cancel.
- You can cancel at any time: the cancellation takes effect at the end of the period already paid. Periods that have started are not refunded, except where the law requires it.
- We may change our prices. A new price applies to your subscription only from your next renewal after at least 30 days' notice by email. You may cancel before it applies.
- Invoices are available in your account or sent by email.
- Late payment: if a payment fails or an invoice is not paid on time, we will tell you and may suspend the Service 15 days after that notice if the situation is not resolved. As required by French law between professionals, any late payment gives rise to late-payment interest at three times the French legal interest rate and to a fixed compensation of €40 for recovery costs.
7. Sites and traffic allowance
Each Plan includes a maximum number of Sites and a number of Page views per month across all your Sites, as shown on freqo.eu. If you go above it, we will tell you. Occasional peaks are fine. If your traffic stays above your allowance for two months in a row, we may ask you to move to the Plan that fits your traffic. Above one million Page views a month, a custom plan is agreed with you.
8. Your responsibilities
You are responsible for how you use Freqo on your Sites. In particular, you agree to:
- Use the Service only on Sites you own or are authorised to manage, and only for lawful purposes.
- Inform your Visitors about audience measurement in your own privacy policy, and choose the mode (Essential, Freqo banner or your own consent tool) and the banner texts that suit your Sites and your legal obligations. Freqo provides tools designed for GDPR; it does not provide legal advice, and the compliance of your Sites remains your responsibility as data controller.
- Not send personal data to the Service beyond what it collects by design: for example, no email addresses, names or identifiers in page addresses, event names or event properties.
- Not use Freqo to identify or follow individual people, to measure sites with illegal content, or to process special categories of data.
- Not disrupt the Service: no overloading, scraping, sending of fake traffic, attempts to bypass security or limits, reverse engineering, or resale outside the Agency plan.
9. Our commitments
- We do our best to keep the Service available, secure and accurate, and to fix problems quickly. The Service is provided without a guaranteed availability rate (no SLA), unless agreed otherwise in writing.
- Maintenance may interrupt the Service briefly. We schedule it, when we can, at times of low traffic.
- We keep daily backups of the data, retained for 14 days.
- We answer support requests sent to hello@freqo.eu as soon as possible, on French business days.
10. Personal data
For the data collected on your Sites, you are the data controller and we act as your processor, under the data processing agreement. For the data of your account (name, email, billing), we are the data controller, as explained in our privacy policy.
11. Intellectual property
The Service, its software, design and brand belong to HSLP. We grant you a personal, non-exclusive and non-transferable right to use the Service for the duration of your subscription. Your statistics belong to you: you can export them at any time. If you send us suggestions, we may use them freely to improve Freqo.
12. Suspension and termination
- You can stop using Freqo at any time by cancelling your Plan or deleting your account.
- We may suspend or close an account, after notice by email and a reasonable time to fix the problem, in case of serious or repeated breach of these terms or unpaid invoices. In urgent cases (security, abuse, illegal content, a danger to the Service or to other users), we may suspend immediately and will tell you why.
- When an account is deleted, its Sites and statistics are deleted for good, immediately in our live systems and within 14 days in our backups. Invoices are kept as required by law. A record of the domains that used a free trial is kept to prevent repeated trials.
13. Liability
We are liable for direct damage caused by a breach of our obligations under these terms. We are not liable for indirect damage such as loss of revenue, loss of business, loss of opportunity or damage to reputation, nor for damage resulting from your own choices (configuration, banner texts, legal basis chosen) or from a breach of your obligations.
Our total liability, for all claims over a period of twelve months, is limited to the amounts you paid for the Service during the twelve months before the event giving rise to the claim. These limits do not apply in case of gross negligence or wilful misconduct, or where the law does not allow them.
14. Force majeure
Neither party is liable for a failure caused by an event beyond its reasonable control, as defined by article 1218 of the French Civil Code, such as a major failure of the hosting provider or of networks, a natural disaster, or a decision of a public authority.
15. Changes to these terms
We may update these terms. We will tell you by email or in the dashboard at least 30 days before an important change takes effect. If you do not agree, you can cancel before that date. Continuing to use the Service after that date means you accept the new terms.
16. Governing law and disputes
These terms are governed by French law. In case of a dispute, we will first try to find an amicable solution: write to hello@freqo.eu. Failing an agreement within 30 days, the dispute will be brought before the competent courts of Nantes, France.
These terms are written in English. If a translation is provided, the English version prevails.
